When you use our product Fauna, we collect information you choose to share: your mood check-ins, how you’re feeling, activity logs, class attendance, and your personal journey entries. We also collect basic technical information (like your device type) to keep the app running. Additionally, The Resting Garden uses website analytics to create and collect your email if you enroll in our newsletter.
Why We Collect It
To support your wellness journey. Your mood and activity data helps Fauna personalize your experience. We may use anonymized, grouped data to improve our programs — but never in a way that identifies you.
What We Will Never Do
Sell your personally identifiable data. Show you ads based on your wellness data. Share your personal information without your permission. Use your story to profit in ways that don’t serve you.
Your Rights
You can ask to see your data, correct it, or have it deleted at any time. You can stop sharing at any time. You will not lose access to the garden for exercising your rights.
Your Wellness Data Is Sensitive and Treated That Way
Your mood logs, journal entries, and health journey data are held with heightened protection. We know that for our community in particular, this kind of information has historically been misused. We do not take that lightly. Your full legal rights are explained in detail in the policy below.
A Note Before You Read
The Resting Garden was built on trust — especially the trust of Black parents, birthing people, and families who have too often been failed by systems that held their most sensitive information. Fauna, our wellness tracking application, is designed to support your personal journey. The data you share with us is yours. This policy explains plainly what we collect, why we collect it, how we protect it, and how you can control it.
We wrote this in plain language because you deserve to understand it — not navigate it.
1. Who We Are
The Resting Garden is a New Jersey-based wellness organization founded in 2020 to support the Black maternal and infant health community through doula care, yoga, education, and community programming. Fauna is a feature/application operated by The Resting Garden on behalf of Haus of Orion, accessible through www.therestinggarden.com or your native mobile application store.

2. What Data We Collect
Fauna may collect the following categories of information when you use the application:
2a. Information You Provide Directly
• Account information: name, email address, password
• Demographic information: age range, pregnancy/postpartum status, preferred pronouns
• Mood check-ins: emotional state, feelings, and self-reported wellness scores
Activity logs: physical activity, yoga attendance, rest, sleep patterns
Event and class attendance records
Journey mapping entries: personal reflections, goals, milestones, and notes
Health and wellness notes you choose to enter
2b. Information Collected Automatically
• Device type, operating system, and browser
• IP address and approximate location (city/region level)
• App usage patterns: features accessed, time spent, session frequency
• Cookies and similar tracking technologies (see Section 7)
2c. Sensitive Data
Mood tracking, journey mapping, and health-related entries may constitute sensitive personal data under applicable law. We treat all wellness data with heightened protection and will never use this data for advertising, profiling for commercial purposes, or share it without your explicit consent.
3. How We Use Your Data
We use the information collected for the following purposes:
• To provide, operate, and improve the Fauna application and its features
• To personalize your wellness experience and track your self-reported journey
• To send you appointment reminders, class confirmations, and service updates
• To communicate with you about programs, events, and community offerings (only with your consent)
• To analyze aggregate, anonymized patterns to improve our programming and community support
• To comply with legal obligations
We do NOT use your personal data for:
• Selling or renting your information to third parties
• Targeted advertising or behavioral marketing
• Automated decision-making that affects your access to services
• Research or publication without your separate, explicit written consent
4. Legal Basis for Processing (NJ & U.S. Residents)
Under the New Jersey Data Privacy Act (NJDPA, effective January 15, 2025) and other applicable privacy frameworks, we process your data based on the following legal grounds:
• Consent: for sensitive wellness data, mood tracking, and journey mapping — you may withdraw consent at any time
• Contract performance: to deliver services you have registered for
• Legitimate interests: for security, fraud prevention, and service improvement — balanced against your rights
• Legal obligation: where required by applicable law
5. How We Share Your Data
We do not sell your personal information. We may share information only in the following limited circumstances:

We work with trusted third-party vendors who help us operate Fauna (e.g., cloud hosting, email delivery, analytics). These providers are contractually required to use your data solely to provide services to us and may not use it for their own purposes. Current or anticipated service providers may include:

Depending on your location, you may have the following rights regarding your personal data:
• Access: request a copy of the personal data we hold about you
• Correction: request we correct inaccurate or incomplete information
• Deletion: request we delete your personal data (subject to legal retention requirements)
• Portability: receive your data in a structured, machine-readable format
• Opt-out: opt out of any non-essential data processing, including marketing communications
• Withdraw consent: withdraw consent for sensitive data processing at any time, without affecting prior lawful processing
• Non-discrimination: we will not deny services or penalize you for exercising your privacy rights

Fauna and www.therestinggarden.com use cookies and similar technologies to:

8. Data Security

• Access controls limiting who within our organization can view sensitive wellness data

No method of transmission over the internet is 100% secure. We encourage you to use strong passwords and contact us immediately at info@therestinggarden.com if you suspect unauthorized access to your account.
In the event of a data breach affecting your rights and freedoms, we will notify you as required by applicable law.
9. Data Retention
We retain your personal data for as long as necessary to provide our services and fulfill the purposes described in this policy. Specifically:
• Active account data: retained while your account is active
• Wellness and journey data: retained for the duration of your membership plus e.g., 2 years, unless you request deletion earlier
• Financial/transaction records: retained as required by law (typically 7 years)
You may request deletion of your wellness data at any time. Upon verified request, we will delete or anonymize your data within 60 days.
10. Children's Privacy
Fauna is not directed to individuals under the age of 13. We do not knowingly collect personal information from children under 13 without verifiable parental consent. If you believe we have inadvertently collected data from a child under 13, please contact us immediately at info@therestinggarden.com and we will delete it promptly.
For users between 13 and 17, we encourage parental review of this policy.
11. Third-Party Links
Our website and app may contain links to third-party platforms (e.g., Substack, Calendly, social media). This Privacy Policy does not apply to those platforms. We encourage you to review the privacy policies of any third-party service you use.
12. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. When we make material changes, we will:
• Update the "Last Updated" date at the top of this policy
• Notify active members via email and/or an in-app notice
Your continued use of Fauna after notification constitutes acceptance of the updated policy.

Yes! You can cancel your app or group class membership at any time.

For members who want live classes, the Fauna has a booking link that allows you access to book classes up to 30 days in advance with your class facilitator.

All sales are final however you can opt in to cancel your membership and utilize your class credits or use of the platform before the next billing date.
